The organization's personnel must be familiar with the organization's regulations establishing labor protection requirements at the enterprise. Compliance with these rules will ensure safety in the organization and eliminate the possibility of accidents and injuries. Knowledge testing on labor protection is carried out by a special commission, which is appointed by order of the director.

In order for employees to comply with all the necessary rules and requirements, it is necessary to know them. For this purpose, briefings are carried out (initial upon hiring, repeated at the workplace, periodic when introducing new equipment). They are carried out by persons appointed by order of the head as inspectors. Upon completion of the briefing, a registration entry is made in a special journal, where the employee signs. This signature will mean that he has studied the labor safety documents, knows all the requirements and undertakes to comply with them.

However, practice shows that not all employees approach this issue responsibly. In order to check the level of awareness of workers, knowledge tests of labor protection requirements are carried out. To test knowledge, a commission is created, the composition of which is approved by order of the director of the organization.

The task of the commission members is to check how correctly workers understand labor safety requirements and whether they know them. Such inspections are carried out at certain intervals, of which employees are notified in advance.

Creation of a commission to test knowledge of labor protection using an order

The order indicates the reason for which this document is being drawn up, after which a list of the director’s orders is provided, which may include the order:

  • conduct a knowledge test on labor protection among a certain group of employees - the list of employees can be given in the appendix to the order; the period for conducting the test is also indicated;
  • create a commission that will ensure proper testing of knowledge of labor protection requirements - a list of responsible persons included in the commission is provided, including its chairman; among the members of the commission there may be representatives of the labor protection department, human resources department, trade union;
  • appoint responsible persons who will inform employees about the upcoming inspection, who will inform the appointed members of the commission of their responsibilities, who will ensure control over compliance with the orders of the manager set out in this order.

The order form is approved by the manager’s visa. Next, it is handed over to the members of the knowledge testing commission for review - their visas are placed below on the form. Also, the responsible persons indicated in the order must put their signatures.

Legal requirements

Based on Article 225 of the Labor Code of the Russian Federation, absolutely all employees must undergo not only occupational safety training, but also testing of knowledge of occupational safety requirements. Including:

  • management;
  • employers are businessmen (IP).

The current rules for testing knowledge of personnel labor protection requirements were approved by a joint resolution of the Ministry of Labor and the Ministry of Education of Russia dated January 13, 2003 No. 1/29.

Order form

The Ministry of Labor of the Russian Federation has not developed a mandatory form for an order to test knowledge of labor protection at an enterprise. There is also no order form recommended by this department. Therefore, when issuing it, it is necessary to be guided by the general rules for issuing such orders adopted at the enterprise.

This order is the basis for starting to test the knowledge of the current staff regarding labor safety standards. Its necessity lies in the fact that each organization is periodically subject to inspection for compliance with mandatory requirements in the field of mandatory labor protection, which also applies to employees. Each specialist must have basic knowledge in the specified area, and the immediate director of the organization must monitor this. How exactly this order is drawn up, what tasks are indicated in it, and what are the reasons for its creation will be described below.

Order on the creation of a labor protection commission - reasons for its creation

The creation of the commission has only one goal, which is to test the knowledge of each employee regarding the current provisions in the occupational safety segment. The head of the enterprise must carry out such organizational activities constantly, at least twice a year - clause 2 of the methodological recommendations of Federal Law-105. The fact is that exactly twice a year an organization can undergo an internal audit by the certification executive commission. Which certifies the knowledge of workers in this area and draws up a document based on the results, which is then submitted to the control authorities. Consequently, a commission is created to carry out internal certification of compliance with mandatory labor protection standards in relation to each employee.


This is done to achieve objectivity of verification in a particular organization. The commission must be independent, so the knowledge of employees will also be checked independently. Moreover, the order for its creation is not subject to disclosure, so that the work of the commission is not initially subject to external influence. This requirement is also included in the list of main ones. The main requirement for the created commission is to obtain answers to local questions regarding labor protection standards, identifying specific workers.

How to correctly draw up an order to create a labor safety commission

The creation order must meet several mandatory requirements. The main requirements, as a rule, concern its structure. The order consists of several parts, with the obligatory designation of the necessary data in each of them. The first part indicates the name of the order - in this case, it is a local order to monitor workers’ knowledge regarding occupational safety regulations. The second part of the order is the main one, and therefore it contains more information. The following data is noted here:

  • Chairman - an employee who will be formally responsible for the activities of the general commission;
  • Composition - the total number of all employees who will be subject to the described requirements for certifying the knowledge of the rest of the staff;
  • Satisfaction criteria - several varieties/directions of the desired result, and evaluation rules;
  • List of powers - here usually indicates full access to all structural divisions of the organization with the possibility of requesting the necessary documents, and even with the possibility of excluding the inspected employees from performing their main functions;
  • Time of conduct - indicating the deadline for submitting results;
  • Statement.

Three-stage control

Three-stage control in the labor protection management system is the main form of control by representatives of the employer and the workforce of the institution over the state of safety and labor protection conditions at workplaces, production sites and workshops, compliance by all services, officials and employees with the requirements of labor legislation. It is an important factor in the system of measures for labor protection and improving production standards, reducing injuries and illnesses, and ensures collective responsibility for the state of labor protection - from the ordinary employee to the head of the institution.

Three-stage control does not exclude administrative control in accordance with Art. 20 of the Federal Law on Trade Unions, Their Rights and Guarantees of Operations dated January 12, 1996 No. 10-FZ.

Three-stage monitoring of the state of labor protection is carried out:

At the first stage - on the site (offices, workshops);

At the second stage - in the institution, in areas assigned to members of the commission (committee) on labor protection;

At the third stage - on the institution as a whole.

Management of the three-stage control organization is carried out by the employer and the head of the workers' trade union body.

The first stage of three-stage control is carried out by the head of the relevant section (department) and the authorized (trusted) person for labor protection of a trade union or work collective (Resolution of the Ministry of Labor of Russia On approval of recommendations for organizing the work of an authorized (trusted) person for labor protection of a trade union or work collective dated 8 April 1994 No. 30). Control is carried out daily at the beginning of the working day.

At the first stage of three-stage control, the following is checked:

implementation of measures to eliminate violations identified by the previous inspection;

the condition and correct organization of workplaces (location and availability of the necessary tools, devices, workpieces, etc.);

condition of passages, passages, driveways;

safety of educational or technological equipment, lifting and transport vehicles;

compliance by employees with electrical safety rules when working on electrical installations and power tools;

compliance with the rules for storing blanks and finished products;

serviceability of supply and exhaust ventilation, local suction, dust collection devices;

Availability and compliance by personnel of labor protection instructions;

availability and correct use of personal protective equipment (PPE);

Violations and shortcomings identified during the inspection are entered into a special journal at the first stage, deadlines and those responsible for execution are determined. If violations of labor protection and safety regulations are detected, measures are taken to eliminate them on the spot.

In case of gross violation of labor safety rules and regulations, work is suspended until this violation is eliminated.

The second stage of three-stage control is carried out by the commission (committee) on labor protection, as a rule, weekly, but at least twice a month in areas assigned to members of the commission. The inspection sites and schedule are established by the chairman of the commission in agreement with the members of the commission.

At the second stage of three-stage control, the following is checked:

organization and results of the first stage of control;

implementation of activities planned as a result of the second and third stages of control;

implementation of orders and instructions of the head of the institution, decisions of a trade union or other representative body of workers, proposals of authorized (trusted) persons on labor protection;

implementation of measures according to the instructions and instructions of supervisory and control authorities;

carrying out activities based on accident investigation materials;

state of compliance with the requirements of fire and electrical safety rules, safety regulations, sanitary and hygienic standards;

serviceability and compliance of educational and production equipment, vehicles and technological processes with the requirements of labor safety standards and other regulatory and technical documentation on labor protection;

compliance by employees with electrical safety rules when working on electrical installations and with power tools;

compliance with schedules and scheduled preventive maintenance of educational and production equipment, ventilation and aspiration systems and installations, technological regimes and instructions;

condition of passages and galleries;

the state of labor protection corners, the presence and condition of labor protection posters, signal colors and safety signs;

availability and condition of protective, special and fire-fighting equipment and devices, instrumentation;

compliance with safety rules when working with harmful and fire-explosive substances and materials;

timeliness and quality of labor safety briefings for employees;

availability and correct use of personal protective equipment (PPE) by employees;

providing workers with therapeutic and preventive nutrition, milk and other preventive means;

condition of sanitary facilities and facilities;

The test results are recorded in a special journal.

The commission outlines activities, determines performers and deadlines. submits a report to the head of the institution.

In the event of a gross violation of labor safety rules and regulations, which may cause harm to the health of workers and lead to an accident, work is suspended by the commission until this violation is eliminated.

The head of the institution must organize the implementation of labor protection measures identified by the commission of the second stage of control.

Monitoring the implementation of these measures is carried out by a specialist from the institution’s labor protection service and a labor protection commissioner.

The third stage of three-stage control is carried out once a month by a commission headed by the head of the institution and the chairman of the trade union or other representative body of workers.

The inspection is carried out in the presence of the manager and the authorized (trusted) person for labor protection of the inspected site.

The inspection schedule is agreed upon with the trade union or other representative body of workers and approved by the heads of the institution.

At the third stage of three-stage control, the following is checked:

organization and results of the first and second stages of control;

implementation of activities planned as a result of the third stage of control;

compliance with the instructions of supervisory and control bodies, orders and instructions of higher authorities, orders and decisions of the trade union committee on labor protection issues;

implementation of activities provided for by the collective agreement, labor protection agreement and other documents;

implementation of activities based on materials from the investigation of severe, group, fatal accidents and accidents;

the state of affairs in the certification of workplaces for working conditions;

technical condition and maintenance of buildings, structures, premises, condition of roadways and pedestrian parts of roads, tunnels, passages and galleries;

compliance of technological, lifting, transport, energy and other equipment with the requirements of safety standards and other regulatory and technical documentation on labor protection;

efficiency of supply and exhaust ventilation;

implementation of schedules for preventive maintenance of production equipment, availability of communication diagrams and connection of power equipment;

provision of workers with special clothing, safety footwear and other personal protective equipment, the correctness of their issuance, storage, organization of washing, cleaning and repair;

provision of workers with sanitary facilities and devices;

conducting periodic medical examinations;

training and testing of knowledge on labor protection of managers and specialists;

condition of corners and occupational safety cabinet;

organization and quality of training and briefings for employees on occupational safety and health;

revision of labor protection instructions;

compliance with the established work and rest regime, labor discipline;

state of compliance with the requirements of fire and electrical safety rules, safety regulations, sanitary and hygienic standards, etc.

The results of the inspection must be documented and discussed at meetings with the head of the institution. At the meeting, positive experience is reviewed, and the heads of areas where unsatisfactory working conditions have been identified are heard, and violations of state labor safety standards, labor protection rules and regulations are allowed. The meeting is documented in minutes; based on its results, an order is issued indicating measures to eliminate identified deficiencies and violations, deadlines and responsible persons.
