I) establishes for organizations carrying out regulated activities, in the event that prices (tariffs) for goods and services of such organizations are subject to establishment by the regulatory body, requirements for programs in the field of energy saving and energy efficiency in relation to regulated activities in accordance with the Rules for Establishing Requirements to programs in the field of energy conservation and energy efficiency of organizations carrying out regulated activities, approved by the Decree of the Government of the Russian Federation of May 15, 2010 N 340;

In accordance with Article 25 of the Federal Law "On Energy Saving and on Increasing Energy Efficiency and on Amending Certain Legislative Acts of the Russian Federation", the Government of the Russian Federation decides:

1. To approve the attached Rules for establishing requirements for programs in the field of energy conservation and energy efficiency improvement of organizations carrying out regulated activities.

2. To establish that the requirements for programs in the field of energy saving and energy efficiency increase of organizations carrying out regulated activities with a validity period in 2010 shall be established within 3 months from the date of entry into force of this resolution, taking into account the following:

1) requirements for programs in the field of energy saving and energy efficiency improvement of organizations carrying out regulated activities in 2010 are established in the form of target indicators for energy saving and energy efficiency improvement, the achievement of which will be ensured by the regulated organization as a result of the implementation of the program, without specifying the values ​​of such indicators;

2) the requirements for programs in the field of energy conservation and energy efficiency of organizations carrying out regulated activities, established in 2010 for 2011 - 2012, are subject to adjustment by April 1, 2011;

3) the requirements for programs in the field of energy saving and energy efficiency improvement of organizations carrying out regulated activities are established taking into account those received within 30 days from the date of entry into force of this resolution from organizations carrying out regulated activities to the federal executive body, the executive body authorities of a constituent entity of the Russian Federation or a local self-government body in the field of state regulation of tariffs, which exercises the functions of state regulation of prices (tariffs) in relation to the relevant organization, proposals regarding:

target indicators of energy saving and energy efficiency and measures with the greatest potential for energy saving and energy efficiency, determined by the organization carrying out regulated activities, based on the approved production and investment programs and prices (tariffs) for goods (services) of such an organization;

energy efficiency indicators of facilities, the creation or modernization of which is planned by the production program, investment program of an organization carrying out regulated activities.

I. General Provisions

1. These Rules determine the procedure for establishing requirements for programs in the field of energy conservation and energy efficiency improvement of organizations carrying out regulated activities (hereinafter referred to as the program).

For the purposes of these Rules, organizations carrying out regulated activities include subjects of natural monopolies and organizations of the communal complex, in respect of which, in accordance with the legislation of the Russian Federation, prices (tariffs) are regulated (hereinafter referred to as regulated organizations).

The effect of these Rules does not apply to heat supply and heating network organizations in terms of determining the planned and calculating actual values ​​of reliability and energy efficiency indicators of heat supply facilities, as well as determining the achievement of the organization carrying out regulated activities in the field of heat supply, the specified planned values ​​to be included in investment programs and concession agreements in accordance with the Federal Law "On Heat Supply".

2. Requirements for the program are established by the federal executive body, the executive body of the constituent entity of the Russian Federation or the local self-government body, which, in accordance with the legislation of the Russian Federation on state regulation of prices (tariffs), regulates prices (tariffs) for goods (services) of the corresponding regulated organization (hereinafter referred to as the regulatory body).

3. When establishing requirements for programs, the regulatory body shall determine the time frame for the regulated organizations to bring their programs in line with the established requirements, which is not less than 3 months.

II. Principles for the Regulatory Authority to Formulate Program Requirements

4. Requirements for the program include:

1) target indicators of energy conservation and energy efficiency, the achievement of which must be ensured by the regulated organization as a result of the implementation of the program (hereinafter referred to as target indicators);

2) a list of mandatory measures to save energy and increase energy efficiency and the timing of their implementation (hereinafter - mandatory measures);

3) indicators of the energy efficiency of facilities, the creation or modernization of which is planned by the production or investment programs of the regulated organization (hereinafter referred to as indicators of the energy efficiency of facilities);

4) values ​​of target indicators and other indicators (if necessary).

By Decree of the Government of the Russian Federation of September 27, 2016 N 971, the Rules are supplemented with clause 4.1

4.1. Program requirements should ensure that the use of LED lighting devices by regulated organizations is brought to the level of:

in 2017 - at least 10 percent of the total volume of used lighting devices;

in 2018 - at least 30 percent of the total volume of used lighting devices;

in 2019 - at least 50 percent of the total volume of used lighting devices;

in 2020 - at least 75 percent of the total volume of used lighting devices.

4.2. Requirements for the programs of electric energy (capacity) producers, whose generating facilities operate in technologically isolated territorial electric power systems and (or) in territories that are not technologically connected with the Unified Energy System of Russia and technologically isolated territorial power systems, should ensure a decrease in specific consumption of equivalent fuel, excluding nuclear fuel, by at least one percent annually relative to the level achieved in 2018.

5. Targets are formed separately for each regulated activity.

6. Target indicators are formed in the form of indicators reflecting the results, the achievement of which is ensured during the implementation of the program, and indicators reflecting the results, the achievement of which is ensured in the course of the implementation of mandatory measures formed by the regulatory body (individual measures or groups of measures).

7. Target indicators and indicators of energy efficiency of objects are established in the form of absolute, relative, specific, comparative indicators or their combinations and reflect:

1) consumption of energy resources used in the production of goods by the regulated organization, in the provision of services, including in the production of a unit of goods (services);

2) consumption of energy resources during their transmission (distribution), including the loss of energy resources;

3) consumption of energy resources in buildings, structures, structures owned by a regulated organization in the implementation of regulated activities;

4) the share of the use of lighting devices using LEDs in the total volume of lighting devices used;

5) the volume of greenhouse gas emissions during the production of a unit of goods (services).

8. When setting the values ​​of target indicators, the stages of their achievement during the implementation of the program, including mandatory measures, are provided.

9. When describing target indicators, it is indicated the need for mandatory determination in the program of the values ​​of target indicators, measures aimed at achieving them, the expected economic, technological effect from the implementation of measures and the expected payback period, and also sets:

( or) territories in which the regulated organization carries out a regulated type of activity, if the determination of values ​​is not limited or excluded by the technological conditions in which the regulated organization carries out a regulated type of activity;

2) the principles of adjusting the calculated values ​​of target indicators by the regulated organization based on the values ​​of such indicators taken into account in the approved production and investment programs of the regulated organization and actually achieved during the execution of the program;

3) the principles for determining the economic and technological effect of the implementation of measures aimed at achieving the established (calculated) values ​​of target indicators and their payback periods by the regulated organization.

10. When describing mandatory measures, it is indicated the need for the regulated organization to determine the expected economic and technological effect from their implementation and the expected payback periods, as well as the principles for determining the economic and technological effect from the implementation of such measures and their payback periods are established.

11. The timing of mandatory measures is formed taking into account the need for their compliance with target indicators, reflecting the results, the achievement of which should be ensured by the regulated organization in the course of the implementation of such measures.

12. Indicators of energy efficiency of facilities are established separately for each regulated type of activity carried out by a regulated organization, for all or part of facilities, the creation or modernization of which is planned by the production program or investment program of the regulated organization.

13. Program requirements are set for each regulated entity. If regulated organizations carry out similar types of regulated activities and have similar economic, technical characteristics and operating conditions, the same requirements for the programs of such organizations may be established. At the same time, the similarity is determined by the regulatory body by comparing the economic, technical characteristics and operating conditions of regulated organizations carrying out similar types of regulated activities.

Program requirements are established by the regulatory body taking into account:

1) received from the regulated organization to the regulatory body no later than February 1 of the year in which the requirements for the program must be established (adjusted) in accordance with paragraph 16 of these Rules, proposals in the part:

target indicators and their values, the achievement of which is ensured by the regulated organization during the implementation of the program;

a list of measures to save energy and increase energy efficiency, the implementation of which by the regulated organization will contribute to the achievement of the proposed values ​​of the indicators, the possible timing of their implementation with an assessment of the costs of their implementation;

indicators of energy efficiency of facilities, using which the corresponding regulated type of activity is carried out;

2) the annual reports of the regulated organization received from the regulated organization to the regulatory body no later than February 1 on the actual fulfillment of the established requirements for the program, drawn up in the form approved by the regulatory body;

3) predicted changes in prices (tariffs) for goods (services) of regulated organizations as a result of taking into account the established requirements in the program.

15. When establishing requirements for the program, the regulatory body has the right to reasonably request in writing from the regulated organization additional materials and information necessary to establish the requirements for the program, indicating the form and timing of their submission, and the regulated organization is obliged to submit the requested materials and information. The regulator may also use third parties as experts if special knowledge is needed to clarify emerging issues in setting program requirements.

III. The procedure for establishing requirements for the program

16. Requirements for the program are established by the regulatory body starting from 2010 for 3 years, if, in accordance with the legislation of the Russian Federation, the duration of the investment program of the regulated organization exceeds 3 years - for the duration of the investment program. The established requirements can be adjusted annually taking into account the forecast of the socio-economic development of the Russian Federation, developed for the next financial year, the production and investment programs of the regulated organization approved for the same period and the established prices (tariffs) for goods (services) of the regulated organization.

17. Requirements for the program are established by a decision of the regulatory body before April 1 of the year in which the previously established requirements expire, taking into account the provisions of paragraph 16 of these Rules.

18. If the requirements for the program are established for regulated organizations carrying out similar types of regulated activities and having comparable economic, technical characteristics and operating conditions, the names of all such regulated organizations shall be indicated in the decision of the regulatory body.

19. The decision of the regulatory body is sent to the regulated organization within 2 weeks.

13. Program requirements are set for each regulated entity. If regulated organizations carry out similar types of regulated activities and have similar economic, technical characteristics and operating conditions, the same requirements for the programs of such organizations may be established. At the same time, the similarity is determined by the regulatory body by comparing the economic, technical characteristics and operating conditions of regulated organizations carrying out similar types of regulated activities.

14. Requirements for programs are established by the regulatory body taking into account:

1) received from the regulated organization to the regulatory body no later than February 1 of the year in which the requirements for the program must be established (adjusted) in accordance with paragraph 16 of these Rules, proposals in the part:

target indicators and their values, the achievement of which is ensured by the regulated organization during the implementation of the program;

a list of measures to save energy and increase energy efficiency, the implementation of which by the regulated organization will contribute to the achievement of the proposed values ​​of the indicators, the possible timing of their implementation with an assessment of the costs of their implementation;

indicators of energy efficiency of facilities, using which the corresponding regulated type of activity is carried out;

19. The decision of the regulatory body is sent to the regulated organization within 2 weeks.

1) target indicators of energy conservation and energy efficiency, the achievement of which must be ensured by the regulated organization as a result of the implementation of the program (hereinafter referred to as target indicators);

2) a list of mandatory measures to save energy and increase energy efficiency and the timing of their implementation (hereinafter - mandatory measures);

3) indicators of the energy efficiency of facilities, the creation or modernization of which is planned by the production or investment programs of the regulated organization (hereinafter referred to as indicators of the energy efficiency of facilities);

4) values ​​of target indicators and other indicators (if necessary).

4_1. Program requirements should ensure that the use of LED lighting devices by regulated organizations is brought to the level of:

in 2017 - at least 10 percent of the total volume of used lighting devices;

in 2018 - at least 30 percent of the total volume of used lighting devices;

in 2019 - at least 50 percent of the total volume of used lighting devices;

in 2020 - at least 75 percent of the total volume of used lighting devices.

4_2. Requirements for the programs of electric energy (power) producers, whose generating facilities operate in technologically isolated territorial electric power systems and (or) in territories that are not technologically connected with the Unified Energy System of Russia and technologically isolated territorial power systems, should ensure a decrease in specific consumption of equivalent fuel, excluding nuclear fuel, by at least one percent annually relative to the level achieved in 2018.

5. Targets are formed separately for each regulated activity.

6. Target indicators are formed in the form of indicators reflecting the results, the achievement of which is ensured during the implementation of the program, and indicators reflecting the results, the achievement of which is ensured in the course of the implementation of mandatory measures formed by the regulatory body (individual measures or groups of measures).

7. Target indicators and indicators of energy efficiency of objects are established in the form of absolute, relative, specific, comparative indicators or their combinations and reflect:

1) consumption of energy resources used in the production of goods by the regulated organization, in the provision of services, including in the production of a unit of goods (services);

2) consumption of energy resources during their transmission (distribution), including the loss of energy resources;

3) consumption of energy resources in buildings, structures, structures owned by a regulated organization in the implementation of regulated activities;

4) the share of the use of lighting devices using LEDs in the total volume of lighting devices used;

5) the volume of greenhouse gas emissions during the production of a unit of goods (services).

8. When setting the values ​​of target indicators, the stages of their achievement during the implementation of the program, including mandatory measures, are provided.

9. When describing target indicators, it is indicated the need for mandatory determination in the program of the values ​​of target indicators, measures aimed at achieving them, the expected economic, technological effect from the implementation of measures and the expected payback period, and also sets:

( or) territories in which the regulated organization carries out a regulated type of activity, if the determination of values ​​is not limited or excluded by the technological conditions in which the regulated organization carries out a regulated type of activity;

2) the principles of adjusting the calculated values ​​of target indicators by the regulated organization based on the values ​​of such indicators taken into account in the approved production and investment programs of the regulated organization and actually achieved during the execution of the program;

3) the principles for determining the economic and technological effect of the implementation of measures aimed at achieving the established (calculated) values ​​of target indicators and their payback periods by the regulated organization.

10. When describing mandatory measures, it is indicated the need for the regulated organization to determine the expected economic and technological effect from their implementation and the expected payback periods, as well as the principles for determining the economic and technological effect from the implementation of such measures and their payback periods are established.

11. The timing of mandatory measures is formed taking into account the need for their compliance with target indicators, reflecting the results, the achievement of which should be ensured by the regulated organization in the course of the implementation of such measures.

12. Indicators of energy efficiency of facilities are established separately for each regulated type of activity carried out by a regulated organization, for all or part of facilities, the creation or modernization of which is planned by the production program or investment program of the regulated organization.

13. Program requirements are set for each regulated entity. If regulated organizations carry out similar types of regulated activities and have similar economic, technical characteristics and operating conditions, the same requirements for the programs of such organizations may be established. At the same time, the similarity is determined by the regulatory body by comparing the economic, technical characteristics and operating conditions of regulated organizations carrying out similar types of regulated activities.

14. Requirements for programs are established by the regulatory body taking into account:

1) received from the regulated organization to the regulatory body no later than February 1 of the year in which the requirements for the program must be established (adjusted) in accordance with paragraph 16 of these Rules, proposals in the part:

target indicators and their values, the achievement of which is ensured by the regulated organization during the implementation of the program;

a list of measures to save energy and increase energy efficiency, the implementation of which by the regulated organization will contribute to the achievement of the proposed values ​​of the indicators, the possible timing of their implementation with an assessment of the costs of their implementation;

indicators of energy efficiency of facilities, using which the corresponding regulated type of activity is carried out;

2) the annual reports of the regulated organization received from the regulated organization to the regulatory body no later than February 1 on the actual fulfillment of the established requirements for the program, drawn up in the form approved by the regulatory body;

3) predicted changes in prices (tariffs) for goods (services) of regulated organizations as a result of taking into account the established requirements in the program.

15. When establishing requirements for the program, the regulatory body has the right to reasonably request in writing from the regulated organization additional materials and information necessary to establish the requirements for the program, indicating the form and timing of their submission, and the regulated organization is obliged to submit the requested materials and information. The regulator may also use third parties as experts if special knowledge is needed to clarify emerging issues in setting program requirements.

III. The procedure for establishing requirements for the program

16. Requirements for the program are established by the regulatory body starting from 2010 for 3 years, if, in accordance with the legislation of the Russian Federation, the duration of the investment program of the regulated organization exceeds 3 years - for the duration of the investment program. The established requirements can be adjusted annually taking into account the forecast of the socio-economic development of the Russian Federation, developed for the next financial year, the production and investment programs of the regulated organization approved for the same period and the established prices (tariffs) for goods (services) of the regulated organization.

17. Requirements for the program are established by a decision of the regulatory body before April 1 of the year in which the previously established requirements expire, taking into account the provisions of paragraph 16 of these Rules.

18. If the requirements for the program are established for regulated organizations carrying out similar types of regulated activities and having comparable economic, technical characteristics and operating conditions, the names of all such regulated organizations shall be indicated in the decision of the regulatory body.

19. The decision of the regulatory body is sent to the regulated organization within 2 weeks.
